01Disambiguation

What is a warranty letter, and how is it different from a claim letter or a demand letter?

A warranty letter is the umbrella term, but it covers three different documents that get confused.

A warranty letter can mean any written communication about a product warranty. A warranty claim letter is the polite first request you send to a brand asking them to honor your coverage (repair, replace, or refund). A demand letter is the formal legal escalation you send after a claim letter has been ignored or denied; it usually cites the Magnuson-Moss Warranty Act and threatens further action. For most consumers, start with a warranty claim letter. Reserve the demand letter for when the company refuses to honor a legitimate claim.

02Federal law

Does the Magnuson-Moss Warranty Act apply to my situation?

Probably yes, if you are a consumer buying a consumer product for over $15.

The federal Magnuson-Moss Warranty Act protects buyers of any consumer product whose written warranty is enforceable, gives you the right to recover attorney fees if you win a lawsuit, prohibits sellers from disclaiming implied warranties when they provide a written one, and bans tying clauses that require you to use brand-name parts or service (the so-called anti-tying rule). The Act applies to products like appliances, electronics, vehicles, tools, and outdoor gear. It does NOT apply to commercial purchases or to services. Cite this Act by name in your claim or demand letter to signal you know your rights.

Should I send a warranty letter by email, certified mail, or through the brand’s portal?

It depends on the brand and the stage.

  • Start with the brand’s online portal or warranty form if one exists. Most large manufacturers (Apple, Samsung, Whirlpool, Bosch, Otterbox) route claims this way and respond faster.
  • Use email for mid-size brands without a portal, attaching photos, receipts, and the warranty document.
  • Escalate to certified mail with return receipt when the brand has ignored two reasonable email attempts, or when you are sending a demand letter that you may later need to prove was received.

Always keep a written log of every contact attempt: dates, names, case numbers, and what was said.

04Expired

What if my warranty has expired, do I still have any rights?

Possibly yes, depending on three things.

First, the implied warranty of merchantability under the Uniform Commercial Code lasts up to four years in most states, even when the manufacturer’s written warranty has expired. This means a $2,000 dishwasher that dies after 18 months may still be covered by implied warranty even though the written warranty was 12 months. Second, state lemon laws extend rights for vehicles. Third, the FTC’s defect-during-warranty rule says if you reported the defect during the warranty period in writing, the seller may have to fix it even if repair happens after the period ends. Document the defect and the report date before doing anything else.

05Anti-tying

Can the company void my warranty because I had a third-party repair or modified the product?

Usually no, and this is the most misunderstood point in warranty law.

The Magnuson-Moss anti-tying rule makes it illegal for a brand to require you to use only their parts or only their service centers to keep a warranty valid, unless those parts or services are provided free or the FTC has granted a waiver. So having a third-party repair, using off-brand parts, or doing minor modification does NOT automatically void your warranty. The brand has to prove the third-party work actually caused the failure they are now refusing to cover. If they refuse on this basis without proof, you have a strong claim.

What if the brand ignores my warranty letter?

Escalate in five stages.

  1. Send a follow-up after 14 days, referencing your first letter, the date sent, and any case number.
  2. File a Better Business Bureau complaint at bbb.org. Brands respond to BBB to protect their rating.
  3. File a complaint with the FTC at reportfraud.ftc.gov and with your state Attorney General consumer protection division. Both forward complaints to the company.
  4. Send a formal demand letter citing the Magnuson-Moss Warranty Act, giving the company 14 to 30 days to respond.
  5. File in small claims court if the disputed amount is under your state’s limit (typically $5,000 to $10,000), or pursue a federal Magnuson-Moss lawsuit where you may recover attorney fees.

08Warranty types

Extended warranty vs implied warranty vs manufacturer warranty, what am I claiming under?

Three different products, three different rules.

  • An extended warranty is a service contract you (or the retailer) paid extra for, typically not regulated as a warranty by the FTC and governed by its own contract terms.
  • An implied warranty is created automatically by state law (UCC Article 2) on every consumer sale, lasts up to four years, and cannot usually be disclaimed when a written warranty exists.

Figure out which one applies before you write: cite the manufacturer warranty if it is still in force, the extended warranty contract if you paid for one, or the implied warranty of merchantability if the written ones have expired but the product failed prematurely.
