Industrial Gross Lease Agreement Template FAQ

What is an industrial gross lease agreement?

An industrial gross lease agreement is a contract where a landlord leases industrial property (such as a warehouse, distribution center, or light manufacturing space) to a tenant, and the rent is structured as “gross.” In a gross lease, the landlord typically pays certain property operating expenses, and the tenant pays a single rent amount plus any costs specifically assigned to the tenant in the agreement.

What expenses are usually included in a gross lease?

Often, the landlord covers items like property taxes, building insurance, and common area maintenance for the property. However, the exact list varies, so the agreement should clearly state which expenses are included in rent and which are billed separately to the tenant.

How is a gross lease different from a net lease?

In a net lease, the tenant usually pays rent plus some combination of taxes, insurance, and maintenance costs. In a gross lease, rent is designed to cover more landlord-paid expenses, which can make monthly costs more predictable if the included expenses are clearly defined.

What should be included in an industrial gross lease agreement?

Common terms include: property description, term, rent and payment terms, security deposit, what expenses are included in rent, utilities, maintenance and repairs, permitted use, compliance rules (including safety and hazardous materials), insurance, default remedies, and termination or renewal terms.

Why does an industrial lease need special clauses?

Industrial spaces often involve loading docks, heavy equipment, storage, and safety requirements. The lease should address access hours, truck routes, parking, loading areas, permitted operations, and responsibilities for repairs and compliance to reduce risk and disputes.
