Do I need a different car rental agreement for each US state?

Yes, in most cases.

04Insurance

Is my personal auto insurance valid when I rent my car privately or through Turo / Getaround?

Usually no, in two ways.

  • Personal auto policies (Progressive, Allstate, State Farm, GEICO, Liberty Mutual) include a "livery exclusion" or "rental for hire" exclusion that voids coverage the moment you accept payment for use of your car.
  • Platforms like Turo and Getaround provide their own insurance during the rental period (Turo offers tiered protection up to $750,000 in some plans; Getaround includes liability and physical damage), but coverage gaps exist before and after the booking window.

For private (non-platform) rentals, you must either purchase a commercial rideshare or livery endorsement, or carry a commercial auto policy. Check your declarations page before listing your car.

05Liability

Who is liable in an accident, owner, renter, or the platform?

The renter is liable for damage during the rental period; that is the baseline.

The owner is usually shielded from third-party claims by the federal Graves Amendment (49 U.S.C. §30106), which preempts state vicarious-liability laws as long as the owner is in the business of renting vehicles and was not negligent. Florida’s §627.7483 (2024) extends similar protection to peer-to-peer platform hosts. New York imposes a statutory liability cap. If the owner was negligent (knew about a brake defect and rented anyway), Graves does not apply. Always document the vehicle’s condition with photos at pickup and require the renter to acknowledge in writing.

How much can I charge as a security deposit, and when must I return it?

State law varies.

Typical commercial rental holds range from $200 to $400, with $200 to $300 common in CA, IL, TX, WA and slightly higher ($200 to $400) in NY. There is no federal cap, but states regulate the return window: most require return within 14 to 45 days after the rental ends, less any documented damage. Florida and California require itemized deductions in writing. Withholding the full deposit without documentation can expose the owner to bad-faith damages. For private or peer-to-peer rentals, define the deposit, the damage-deduction rules, and the return deadline in the agreement itself.

07Tax

Do I need to report rental income from my car (Turo, Getaround, private)?

Yes. Income from renting your car is taxable, and the IRS treats it differently based on volume.

  • Occasional / sporadic rentals (a few times a year, friend to friend) usually go on Schedule E as rental income, with depreciation and expenses deductible against gross.
  • Regular business activity (Turo full-time host with multiple vehicles) is treated as Schedule C self-employment income, subject to self-employment tax.
  • Turo and Getaround issue Form 1099-K if you cross IRS reporting thresholds.
  • State excise taxes apply in WA, IL, FL on rental transactions.
