SUBLEASE AGREEMENT FAQ

What is a Sublease Agreement?

A sublease agreement is a legal contract in which an existing tenant rents all or part of their leased property to another tenant, known as the subtenant. The agreement outlines the rental terms, responsibilities, and rights of both the original tenant and the subtenant, while ensuring compliance with the original lease. Subleases can apply to residential or commercial spaces and typically require the landlord’s written consent before taking effect.

Why do you need a Sublease Agreement?

You need a sublease agreement to clearly define each party’s obligations, protect yourself from disputes, and ensure the subtenant adheres to the conditions of the original lease. It provides legal protection for the original tenant (sublessor), the subtenant, and often the landlord by documenting rent amounts, usage rules, maintenance responsibilities, and liability for damages. This is particularly important to avoid misunderstandings or potential breaches of the original lease.

When should you use a Sublease Agreement?

Use a sublease agreement when you are the current tenant of a property but need to rent it out temporarily to another person, such as when relocating for work, traveling for an extended period, or sharing part of your rented space. Subleasing can be a way to cover rental costs without breaking your lease, but it must be done in accordance with your landlord’s policies and local laws.

How to write a Sublease Agreement?

Identify the original tenant and the subtenant, and include detailed property information. Clearly outline the rental period, payment terms, security deposit arrangements, and any utilities or services included. Reference the original lease and state any restrictions that carry over. Define rules for property use, maintenance, repairs, and liability. Both the sublessor and subtenant should sign the agreement, and the landlord’s approval should be obtained in writing before it becomes effective.
