5. Security Deposit

The Security Deposit is held as security for Tenant’s obligations under this Agreement, including payment of rent and fees and repair of damage to the Space or park property beyond normal wear and tear.
After Tenant vacates the Space, removes the RV and personal property, and returns any keys/access devices, Landlord will return any remaining Security Deposit, less lawful deductions, within the time required by applicable law. If required, Landlord will provide an itemized statement of any deductions.

The Tenant may occupy the Space only with the RV described below (the “RV”), unless Landlord approves a replacement RV in writing:

7. Use and Occupancy
7.1 Permitted Use
The Space is rented only for:
Parking and occupying the RV identified in Section 6; and
Reasonable outdoor use of the immediate area within the boundaries of the Space, consistent with park rules.
7.2 Occupancy Limits

7.3 Prohibited Uses
Without Landlord’s prior written consent and subject to local law, Tenant will not:
Use the Space or park for illegal activity;

Sublet the Space or assign this Agreement;
Rent out the RV on the Space as a hotel or short-term rental to others;
Erect permanent buildings, large decks, or fences beyond what is allowed by park rules and local codes;
Store boats, trailers, or extra vehicles on the Space except as permitted in writing.
8. Utilities and Services

9. Park Rules and Conduct
Tenant agrees to comply with all written park rules, regulations, and policies provided by Landlord and any reasonable updates given in writing.
Park rules may cover, for example:
Quiet hours (e.g., “10:00 p.m. to 7:00 a.m.”);
Speed limits within the park;
Use of common facilities and amenities;
Appearance and upkeep of the RV and Space;
Restrictions on loud music, disruptive behavior, fireworks, or open fires not in approved areas;
Procedures for trash disposal, recycling, and yard waste.
10. Vehicles and Parking

12. Maintenance and Repairs
12.1 Landlord Responsibilities
Landlord will:
Maintain park roads, common areas, and utilities under Landlord’s control in a reasonably safe condition, as required by law;
Maintain the general condition of the Space (grading, main utility connections) suitable for RV occupancy, subject to weather and normal wear.
12.2 Tenant Responsibilities
Tenant will:
Maintain the RV, steps, hoses, cords, and personal items in safe and orderly condition;
Keep the Space and area around the RV reasonably clean and free from trash, clutter, and hazards;
Avoid damaging park property and promptly report unsafe conditions or needed repairs;
Be responsible for damage to the Space, utilities, or park property caused by Tenant, occupants, or guests, beyond normal wear and tear.
13. Insurance and Risk of Loss
Tenant is responsible for insuring the RV and Tenant’s personal property in or around the Space.
Tenant understands that Landlord’s insurance generally does not cover Tenant’s RV or personal property.
Tenant occupies and uses the Space and park at Tenant’s own risk, except as otherwise required by applicable law or expressly stated in this Agreement.
Nothing in this section allows Landlord to act fraudulently or to ignore duties imposed by local law regarding premises safety.
14. Default and Remedies
14.1 Tenant Default
Tenant is in default if Tenant:
Fails to pay rent or required fees when due and does not cure within any applicable notice or grace period;
Materially breaches this Agreement or park rules and does not cure within any required notice period;
Uses the Space or park for illegal purposes.
If a default occurs, Landlord may take actions allowed by applicable landlord–tenant or RV park law, which may include written notice, termination of this Agreement, and lawful steps to recover possession of the Space, subject to any required court or administrative procedures.
14.2 Landlord Default
Landlord is in default if Landlord materially fails to perform obligations under this Agreement or applicable law after any required notice and cure period. Tenant’s remedies will be those available under local law and under any lawful terms of this Agreement.
15. Termination and Move-Out
When this Agreement ends for any reason, Tenant will:
Pay all rent and charges owed through the end of the rental period;
Safely disconnect utilities and remove the RV and all personal property from the Space and any storage areas by the move-out date;
Leave the Space reasonably clean and free of trash and abandoned items;
Return any keys, access cards, remotes, or fobs to Landlord.
Any property left behind may be handled according to applicable law, which may include storage, towing, sale, or disposal after any required notices.
16. Notices
All notices under this Agreement must be in writing and delivered by one or more of the following methods, as permitted by law:
Personal delivery;
Certified or registered mail;
Recognized courier service;
Email to the addresses listed in Section 1, if both parties agree to accept email notices.
Notices will be sent to the addresses in Section 1 unless a party provides a new notice address in writing.
17. Miscellaneous
Governing Law
This Agreement is governed by the laws of [State/Province, Country], including any specific RV park or campground regulations that apply.
Entire Agreement
This Agreement, together with any written park rules and addenda referenced in it, is the entire agreement between the parties regarding the Space and park and replaces any prior written or oral agreements on the same subject.
Amendments
Any change to this Agreement must be in writing and signed by both parties, unless applicable law provides otherwise.
Severability
If any part of this Agreement is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
