5. Security Deposit

The Security Deposit is held as security for Tenant’s obligations under this Agreement, including payment of rent and fees and repair of damage to the Lot or park property beyond normal wear and tear.

After Tenant vacates the Lot, removes the trailer/mobile home (if required), and returns any keys/access devices, Landlord will return any remaining Security Deposit, less lawful deductions, within the time required by applicable law. If required, Landlord will provide an itemized statement of deductions.

7. Use and Occupancy

The Lot and Home may be used only as a private residence for Tenant and approved occupants.

Visitors may stay overnight only as allowed by park rules and applicable law.

7.3 Prohibited Uses

Without Landlord’s prior written consent and subject to local law, Tenant will not:

  • Sublet the Lot or assign this Agreement;

  • Speed limits within the park;

  • Use of common areas and amenities;

10. Vehicles and Parking

12. Maintenance and Repairs

12.1 Landlord Responsibilities

Landlord will:

  • Maintain park roads, common areas, and utilities under Landlord’s control in a reasonably safe condition, as required by law;

  • Maintain the general condition of the Lot (grading, main utility connections) suitable for occupancy, subject to weather and normal wear.

12.2 Tenant Responsibilities

Tenant will:

  • Maintain the Home, steps, porches, skirting, and any permitted structures in good repair and appearance;

  • Keep the Lot reasonably clean, mowed (if required), and free from trash, junk, and hazards;

  • Avoid damaging park property and promptly report unsafe conditions;

  • Be responsible for damage to the Lot, utilities, or park property caused by Tenant, occupants, or guests, beyond normal wear and tear.


13. Insurance and Risk of Loss

  • Tenant is responsible for insuring the Home and Tenant’s personal property in or around the Lot.

  • Tenant understands that Landlord’s insurance generally does not cover Tenant’s Home or personal property.

  • Tenant occupies and uses the Lot and park at Tenant’s own risk, except as otherwise required by applicable law or expressly stated in this Agreement.

Nothing in this section allows Landlord to act fraudulently or avoid duties imposed by local law regarding premises safety.


14. Default and Remedies

14.1 Tenant Default

Tenant is in default if Tenant:

  • Fails to pay rent or required fees when due and does not cure within any applicable notice or grace period;

  • Materially breaches this Agreement or park rules and does not cure within any required notice period;

  • Uses the Lot or park for illegal purposes.

If a default occurs, Landlord may take actions allowed by local landlord–tenant or mobile home park law, which may include written notice, termination of the tenancy, and lawful steps to recover possession of the Lot, subject to any required court or administrative procedures.

14.2 Landlord Default

Landlord is in default if Landlord materially fails to perform obligations under this Agreement or applicable law after any required notice and cure period. Tenant’s remedies will be those available under local law and any lawful terms of this Agreement.


15. Termination and Move-Out

When this Agreement ends for any reason, Tenant will:

  • Pay all rent and charges owed through the end of the tenancy;

  • If required or agreed, safely disconnect utilities and remove the Home from the Lot within the time allowed;

  • If the Home remains on the Lot with Landlord’s consent, sign any new lot-rental or storage arrangements required by Landlord and allowed by law;

  • Remove all personal property from the Lot and any storage areas;

  • Leave the Lot reasonably clean and free of trash and abandoned items;

  • Return any keys, access cards, remotes, or fobs to Landlord.

Any property left on the Lot may be handled according to applicable law, which may include storage, sale, or disposal after any required notices.


16. Notices

All notices under this Agreement must be in writing and delivered by one or more of the following methods, as permitted by law:

  • Personal delivery;

  • Certified or registered mail;

  • Recognized courier service;

  • Email to the addresses listed in Section 1, if both parties agree to accept email notices.

Notices will be sent to the addresses in Section 1 unless a party provides a new notice address in writing.


17. Miscellaneous

Governing Law
This Agreement is governed by the laws of [State/Province, Country], including any specific mobile home or manufactured housing park statutes that apply.

Entire Agreement
This Agreement, together with any written park rules and addenda referenced in it, is the entire agreement between the parties regarding the Lot and park and replaces any prior written or oral agreements on the same subject.

Severability
