INFLUENCER MARKETING AGREEMENT TEMPLATE FAQ

What is an influencer marketing agreement?

An Influencer Marketing Agreement is a contract between a brand (or agency) and an influencer/creator that defines campaign deliverables, posting schedule, content guidelines, compensation, and disclosure requirements. It helps both sides avoid misunderstandings about what content is required and how it can be used.

What should be included in an influencer agreement?

Common terms include: campaign scope and deliverables, posting dates, creative guidelines, review/approval process, compensation and expenses, usage rights (whitelisting, ads, reposting), exclusivity or non-compete, confidentiality, compliance with advertising rules (like “#ad”), and termination terms.

Who owns the content an influencer creates?

Often the influencer owns the original content but grants the brand a license to use it for marketing purposes. Some brands request full ownership or paid usage rights. This template uses a practical approach: influencer-owned with a defined license and optional buyout.

How do you handle disclosures and compliance?

Influencers typically must clearly disclose sponsored content (for example, using “#ad” or platform tools). The agreement should require compliance with platform policies and advertising laws. This template includes a disclosure clause and a requirement to follow applicable rules.

Should you include exclusivity?

Exclusivity is optional but common for competitive industries. It prevents the influencer from promoting competitor products during a campaign period. This template includes an optional exclusivity clause you can set by category and timeframe.
