Odometer Statement

Federal and Arizona law (A.R.S. 28-2058) require the seller to deliver an odometer mileage disclosure on transfer of ownership. Providing a false statement may result in fines and/or imprisonment.

Arizona Filing Checklist

Which document transfers ownership. The seller endorses the certificate of title with the warranty of title and hands it to the buyer at delivery (A.R.S. 28-2058). For a vehicle already titled in Arizona, MVD also accepts the Title Transfer Bill of Sale, Form 38-1306, in place of the signed title. The plain Bill of Sale, Form 48-2004, is the supporting record of price, date and identities.

Vehicle License Tax. Part of the annual registration fee: 60% of the manufacturer’s base retail price, reduced 16.25% for each year since first registration, taxed at $2.89 per $100 of assessed value for a used vehicle.

Arizona is unusual in three ways: its state bill-of-sale forms are built to be acknowledged by a notary or an MVD agent; a private sale carries no sales tax at all; and the buyer has only 15 days to title the car and may drive it in the meantime only on a Restricted Use 3-Day Permit.

01 Basics

What is an Arizona vehicle bill of sale, and which state form is it: 48-2004 or 38-1306?

Arizona has two. Form 48-2004, Bill of Sale, is the one-page record of the sale: VIN, year, make and body style, sale date and payment amount, and both parties' names, driver license numbers, dates of birth and addresses. Form 38-1306, Title Transfer Bill of Sale, is a two-page document that can replace the signed title for a vehicle already titled in Arizona.

Both are published by the Motor Vehicle Division (48-2004, rev. 05/25; 38-1306, rev. 07/25). The 38-1306 additionally lists the legal status of co-owners (OR, AND, AND/OR), any Arizona title brand, the current and any new lienholder, and the federal odometer certification, and it warns that the buyer has 15 days to apply for a new title to avoid penalty charges.

This template follows the 48-2004 field for field and adds the odometer statement and lien section from the 38-1306, so one signed copy covers what either form asks.

02 Requirement

Is a bill of sale required for a private car sale in Arizona?

To title a vehicle bought from an individual, MVD asks for the signed vehicle title or, for an Arizona-titled vehicle, the Title Transfer Bill of Sale (Form 38-1306), plus the Title and Registration Application (Form 96-0236) and a lien release if there is a lien. The plain Bill of Sale (48-2004) is the supporting record every buyer should keep.

  • Title endorsement is the transfer. Under A.R.S. 28-2058 the owner endorses the title with the warranty of title and delivers it to the buyer at the time of delivery of the vehicle.
  • Form 38-1306 is the alternative for vehicles already titled in Arizona, and MVD lists it side by side with the signed title on its Vehicle Title page.
  • Form 48-2004 documents the deal: price, date, and the identities of both sides down to driver license number and date of birth.
03 Signing

Does an Arizona bill of sale need to be notarized?

In practice, yes. Both state forms end with the words "Acknowledged before me this date" and a signature line for a notary or an MVD agent, with county, state and commission expiry. Sign it at an MVD or authorized third-party office, or before a notary.

Two more rules printed on the forms: they are void if altered or erased, and sequential bills of sale will not be accepted. Fill the form once, completely, then sign in front of the notary or agent. The seller's driver license number and date of birth on the form are what the acknowledgment ties the signature to.

What has to be on an Arizona vehicle bill of sale?

The fields on Form 48-2004: VIN, year, make, body style; sale date and sale payment amount; the buyer's and the seller's full legal name, driver license number, date of birth and mailing address; the seller's signature and date; and the notary or MVD-agent acknowledgment.

Add what the Title Transfer Bill of Sale asks for and the title transaction will need anyway: the odometer reading with the federal certification (actual, not actual, or in excess of mechanical limits), any Arizona brand on the title, and any lienholder. Where the vehicle has more than one owner, the legal status decides who must sign: with "OR" either owner can sell, with "AND" or "AND/OR" both must.

05 Ownership

Bill of sale versus title: which one transfers the car in Arizona?

The title. Ownership moves when the seller endorses the certificate of title with the warranty of title and hands it over at delivery, and the buyer then applies for a new title within 15 days. The bill of sale records the transaction; it does not by itself make the buyer the owner.

Before paying, check the vehicle in the Title Viewer on AZ MVD Now: it shows Arizona brands (salvage, rebuilt and so on) and recorded liens. Liens are held electronically by the lienholder; a recorded lien has to be released before MVD issues a clean title, so ask for the release at the sale. If the seller holds an out-of-state title, MVD also requires an emissions compliance form for the Phoenix and Tucson areas.

Is there sales tax on a private car sale in Arizona, and what fees does the buyer pay?

No sales tax. The Arizona Department of Revenue states that casual sales between private parties are not subject to transaction privilege tax or use tax. The buyer pays MVD fees and the annual Vehicle License Tax.

  • Title fee: $4.
  • Registration fee: $8.
  • Air quality research fee: $1.50.
  • Vehicle License Tax (VLT): part of the annual registration, computed on 60% of the manufacturer's base retail price reduced 16.25% for each year since first registration, at $2.89 per $100 of assessed value for a used vehicle.

Because there is no sales tax, the price on the bill of sale does not change what the state collects. It still matters as the record of what was paid.

07 Deadlines

What are the deadlines after a private car sale in Arizona?

Buyer: apply for title and registration within 15 days of the transfer. Seller: file a Sold Notice within 10 calendar days and deal with the plates within 30 days. Until registered, the car moves only on a Restricted Use 3-Day Permit.

  • Buyer, 15 days (A.R.S. 28-2058) at an MVD or authorized third-party office or on AZ MVD Now; the 38-1306 warns of penalty charges after that.
  • Buyer, before registration in Phoenix or Tucson: emissions inspection for vehicles model year 1967 and newer; no registration without a passing test or a certificate of waiver (A.R.S. 49-542).
  • Buyer, driving it home: a Restricted Use 3-Day Permit from EZ Permit on AZ MVD Now or an MVD office, valid only for inspection, emissions testing, repairs needed to pass, and completing registration.

08 Mistakes

What are the most common mistakes on an Arizona bill of sale?

Driving off on the seller's plate, a bill of sale nobody acknowledged, a form corrected by hand, and a Sold Notice never filed.

  • Seller's plate on the car. The registration expired at transfer. MVD's answer to "can I drive it?" is no: surrender the plate and get a Restricted Use 3-Day Permit.
  • No acknowledgment. Both state forms expect a notary or MVD agent. An unacknowledged copy is a weak record when a dispute or a title problem comes up.
  • Altered form. Void if altered or erased; sequential bills of sale are not accepted. Start a clean copy.
  • Sold Notice skipped. Without it the seller stays on record as the owner, including for a crash or a crime involving the car.
  • Lien or brand not checked. The Title Viewer on AZ MVD Now shows both before you pay.
  • Missing the 15-day window. Penalty charges apply whether or not the vehicle is being used.
