AS-IS BILL OF SALE TEMPLATE FAQ

What is an As-Is Bill of Sale?

An As-Is Bill of Sale is a written document that records the sale and transfer of property while stating that the item is sold in its current condition, with no warranties or guarantees from the seller. The buyer accepts the risks of defects or problems that may exist.

When should I use an As-Is Bill of Sale?

Use an As-Is Bill of Sale when selling used items such as vehicles, equipment, furniture, electronics, or other property and you want to make clear that the seller is not responsible for defects after the sale, unless otherwise agreed in writing.

What can an As-Is Bill of Sale cover?

This template can be used for many types of personal property, including vehicles (where allowed), tools, machinery, electronics, furniture, collectibles, and other goods. For real estate or special regulated property, additional documents may be required.

What should be included in an As-Is Bill of Sale?

A clear As-Is Bill of Sale usually includes: buyer and seller information, description of the property being sold, total purchase price and payment terms, “as-is” condition language, any liens or encumbrances, and signatures.

Does “as is” mean the buyer has no protection at all?

“As is” means the seller is not promising that the item is free from defects or will work in a particular way. However, it does not permit fraud or misrepresentation. Local law may still require truthful disclosure about known major issues.
