The parties agree as follows:

5. Permitted Use

• use the bicycle for racing, stunts, or unsafe activity;

• use the bicycle while under the influence of alcohol or drugs;

• use the bicycle in violation of traffic, trail, park, or local safety laws;

6. Safety Responsibilities

The Renter agrees to operate the bicycle carefully and in accordance with applicable laws and safety rules.

The Renter is responsible for:

• wearing a helmet if required by law or requested by the Rental Provider;

• using lights or reflective gear when appropriate;

• securing the bicycle when unattended;

• making sure the bicycle is used only by a person capable of riding it safely.

7. Maintenance and Care

The Renter agrees to use reasonable care to protect the bicycle from damage, theft, or misuse during the rental period.

The Renter may not make repairs, changes, or modifications to the bicycle without the Rental Provider’s prior approval, except where immediate action is reasonably necessary for safety.

8. Damage, Loss, or Theft

The Renter is responsible for loss of or damage to the bicycle and any included accessories during the rental period, except to the extent caused by normal wear and tear or the Rental Provider’s own fault where applicable.

If the bicycle is lost, stolen, or damaged, the Renter must promptly notify the Rental Provider and provide any available details, including police report information if relevant.

9. Mechanical Problems

If the bicycle develops a mechanical issue during the rental period, the Renter must stop using it if continued use appears unsafe.

The Renter must notify the Rental Provider as soon as reasonably possible. Any refund, replacement bicycle, or service adjustment will be handled according to the Rental Provider’s policy or the parties’ written agreement.

10. Late Return

If the bicycle is returned after the agreed return time, the Renter agrees to pay a late fee of [Amount or Rate], unless waived by the Rental Provider.

A substantial delay in return may be treated as an unauthorized retention of the bicycle and may result in additional charges or legal action to recover the bicycle, to the extent permitted by law.

11. Assumption of Risk

The Renter understands that riding a bicycle involves inherent risks, including falls, collisions, road hazards, weather conditions, equipment failure, and the actions of other persons.

By using the bicycle, the Renter voluntarily accepts these risks to the extent permitted by applicable law.

12. Liability

To the extent permitted by applicable law, the Rental Provider will not be liable for indirect, incidental, or consequential damages arising from the rental or use of the bicycle.

Nothing in this Agreement is intended to exclude liability that cannot legally be excluded under applicable law.

13. Return of Bicycle

At the end of the rental period, the Renter agrees to return the bicycle and all accessories to: [Return Location].

The bicycle must be returned in substantially the same condition as when rented, excluding normal wear and tear. Any missing item will be charged at its replacement value or other amount permitted by law.

14. Termination
