4. Scheduling and Flight Conditions

The parties understand that drone operations may be affected by:

  • airspace restrictions;

  • site access limitations;

  • interference, crowds, or nearby hazards.

The Drone Operator may delay, reschedule, shorten, or cancel the shoot if flight conditions appear unsafe, unlawful, or impractical.


5. Client Responsibilities

The Client agrees to:

  • provide accurate project details and location information;

  • obtain any necessary property access permission from the owner, manager, or authorized party;

  • disclose known site hazards, restrictions, or special instructions in advance;

  • ensure that the site may legally be photographed or filmed as intended;

  • secure any approvals needed for private property access, event access, or coordinated entry.

The Client understands that the Drone Operator is not responsible for delays or limitations caused by missing permissions, restricted access, unsafe site conditions, or inaccurate project information.


6. Legal Compliance and Flight Restrictions

The Drone Operator agrees to conduct drone operations in accordance with applicable laws, regulations, and safety requirements.

The Client understands that drone flights may be limited or prohibited due to:

  • no-fly zones;

  • restricted airspace;

  • nearby airports or helipads;

  • temporary flight restrictions;

  • weather alerts;

  • crowd or safety restrictions;

  • property or venue rules.

If a requested flight cannot legally or safely be completed, the parties may reschedule, revise the scope, or adjust the fee as agreed.


7. Property and Site Access

The Client will provide access to the site on the agreed date and time.

If the Client is not the property owner, the Client represents that the Client has authority or permission to arrange the services or will obtain that permission before the shoot.

The Drone Operator is not responsible for entering restricted areas or proceeding with a flight where safe launch, landing, or operation is not reasonably available.


8. Editing and Selection

The Drone Operator will select and edit final images and footage in the Drone Operator’s professional judgment.

Standard editing may include basic color correction, exposure adjustment, stabilization, cropping, and similar post-production work. Advanced editing, object removal, custom graphics, detailed retouching, or special revisions are [included / not included / available for an additional fee].

Raw or unedited files will [not be provided / be provided only if separately agreed in writing].


9. Revisions

The Client may request [Number] reasonable revision round(s) to the delivered edited materials within [Number] days after delivery.

10. Copyright and Usage Rights

The Drone Operator retains ownership of the photographs, video, and related copyright, except as otherwise stated in writing.

12. Cancellation and Rescheduling

If the Drone Operator must reschedule due to weather, safety issues, legal restrictions, illness, emergency, or circumstances beyond reasonable control, the Drone Operator may offer a new date or refund amounts paid, depending on the situation.


13. Limitation of Liability

To the extent permitted by applicable law, the Drone Operator will not be liable for indirect, incidental, special, or consequential damages arising from this Agreement or the project.

If services are delayed, reduced, or cannot be completed due to weather, flight restrictions, technical issues, loss of signal, equipment failure, government restrictions, acts of third parties, or unsafe site conditions, the Drone Operator’s liability will be limited to the amount actually paid under this Agreement, unless otherwise required by law.


14. Indemnification

To the extent permitted by applicable law, the Client agrees to indemnify and hold harmless the Drone Operator from claims, losses, or expenses arising from inaccurate site information, lack of required permission, unsafe conditions under the Client’s control, or the Client’s misuse of the delivered materials.

Nothing in this Agreement waives any right or liability that cannot legally be waived.


15. Governing Law

This Agreement will be governed by the laws of [State/Country], without regard to conflict of law principles.


16. Entire Agreement
