2. Rental Period

use the kayak in dangerous weather or water conditions;

6. Safety Requirements
The Renter agrees to follow all safety instructions provided by the Rental Provider and all applicable laws and regulations.
The Renter is responsible for:
wearing a properly fitted life jacket when required or recommended;
using the kayak only in conditions the Renter is capable of handling safely;
staying within approved waterways or areas, if applicable;
monitoring weather, water conditions, and local warnings before and during use;
making sure all passengers or participants follow basic safety rules.
7. Renter Skill and Health Representation
The Renter confirms that the Renter and any approved participant are physically able to use the kayak safely and do not have any known condition that makes such use unreasonably dangerous.
The Renter is responsible for deciding whether the activity is suitable based on experience, swimming ability, health, weather, and water conditions.
8. Minors
No minor may use the kayak unless permitted by the Rental Provider and supervised or authorized as required by law or Rental Provider policy.
If the renter or participant is a minor, a parent or legal guardian must sign this Agreement where applicable.
9. Care of Kayak and Equipment
The Renter agrees to use reasonable care to protect the kayak and included equipment from damage, theft, or misuse during the rental period.
The Renter may not make repairs, modifications, or adjustments to the equipment without prior approval from the Rental Provider, except where immediate action is reasonably necessary for safety.
10. Damage, Loss, or Theft
The Renter is responsible for damage to or loss of the kayak and included equipment during the rental period, except to the extent caused by normal wear and tear or the Rental Provider’s own fault where applicable.
If the kayak or equipment is lost, stolen, damaged, or involved in an accident, the Renter must promptly notify the Rental Provider and provide any available details.
11. Weather and Water Conditions
The Renter understands that weather, water flow, tides, currents, wind, waves, and other natural conditions may change quickly and affect safety.
The Rental Provider may refuse, delay, or cancel the rental if conditions appear unsafe. Any refund, credit, or rescheduling will be handled as follows: [Terms].
12. Assumption of Risk
The Renter understands that kayaking involves inherent risks, including capsizing, collision, drowning, hypothermia, slipping, changing weather, contact with wildlife, submerged objects, and the actions of other persons.
By using the kayak, the Renter voluntarily accepts these risks to the extent permitted by applicable law.
13. Liability
To the extent permitted by applicable law, the Rental Provider will not be liable for indirect, incidental, special, or consequential damages arising from the rental or use of the kayak.

14. Late Return
