5. Client Responsibilities
The Client agrees to:

obtain permission for photography at the venue if required;
ensure the Photographer has reasonable access to key people and event areas;
inform the Photographer about venue restrictions, lighting limitations, or special photography rules;
designate a contact person for coordination on the event day if needed.
The Client understands that delays, restrictions, poor lighting, weather, crowd conditions, or lack of cooperation from attendees may affect the final images.
6. Creative Discretion
The Client understands that the Photographer retains artistic discretion regarding shooting style, posing direction, image selection, editing style, and final delivery choices.
The Photographer will make reasonable efforts to capture requested moments, but does not guarantee the capture of every specific person, moment, or image.
7. Deliverables
The Photographer will provide the following deliverables:

Any deliverable not specifically listed in this Agreement is not included.
8. Editing and Image Selection
The Photographer will select and edit images in the Photographer’s professional judgment.

The Photographer may remove duplicate images, test shots, blurred images, or images that do not meet normal professional standards.
9. Copyright and Client Use
The Photographer retains ownership of the photographs and copyright in the images, except as otherwise stated in writing.
Upon full payment, the Client receives a [personal-use / limited business-use] license to use the delivered images for the following purposes: [personal sharing / marketing / website / social media / internal business use / other].
The Client may not sell, edit, commercially license, or transfer the images to third parties for unrelated use without the Photographer’s written consent.
10. Promotional Use

If permission is not granted, the Photographer will not knowingly use the Client’s event images for public promotion, except as required by law or with later written consent.
11. Cancellation and Rescheduling

any completed work or nonrecoverable expenses may remain payable;

If the Client reschedules the event, the Photographer will make reasonable efforts to accommodate the new date, but rescheduling is subject to availability.

12. Photographer Inability to Perform
If the Photographer is unable to perform due to illness, emergency, accident, or another serious circumstance beyond reasonable control, the Photographer may:
provide a qualified replacement, if available; or
refund some or all amounts paid, depending on the circumstances and any substitute services provided.
This section does not limit any rights that cannot legally be waived under applicable law.
13. Limitation of Liability
To the extent permitted by applicable law, the Photographer will not be liable for indirect, incidental, special, or consequential damages arising out of this Agreement or the event.
If images are lost, damaged, corrupted, or not captured due to equipment failure, memory card failure, venue restrictions, poor conditions, acts of third parties, or circumstances beyond reasonable control, the Photographer’s liability will be limited to the amount actually paid by the Client under this Agreement, unless otherwise required by law.
14. Force Majeure
Neither party will be liable for failure or delay in performance caused by events beyond reasonable control, including severe weather, natural disasters, government restrictions, venue closure, public emergencies, strikes, or similar events.
If such an event materially affects performance, the parties will work in good faith to determine whether the event can be rescheduled or whether refunds or credits will apply.
15. Governing Law
This Agreement will be governed by the laws of [State/Country], without regard to conflict of law principles.
16. Entire Agreement
This Agreement represents the entire understanding between the parties regarding the event photography services and supersedes prior oral or written discussions on the same subject.
