Marital Settlement Agreement FAQ

What is a Marital Settlement Agreement?

A Marital Settlement Agreement (MSA) is a written contract between spouses that resolves all major issues arising from their marriage, such as property division, debts, child custody, and support. It is often submitted to the court for approval as part of a divorce decree.

Why is a Marital Settlement Agreement important?

It provides clarity and legal enforceability to the decisions made during divorce, preventing future disputes. By formalizing terms in writing, both parties protect their rights and ensure compliance with state family laws.

When should you use a Marital Settlement Agreement?

Use it when both spouses agree on the terms of their separation or divorce before going to court. It is especially useful in uncontested divorces to streamline the process and avoid unnecessary litigation.

What should a Marital Settlement Agreement include?

The agreement should address asset and debt division, spousal support, child custody and visitation, child support, health insurance, tax responsibilities, and any other agreed terms.

Is a Marital Settlement Agreement legally binding?

Yes. Once signed and filed with the court, it becomes part of the final divorce judgment, making it enforceable by law.
